Man sentenced for selling pot to informant on Turtle Mountain Reservation

Derrick Allery, 26, of Rolla, ND, was sentenced Aug. 29 on a charge of conspiracy to possess with intent to distribute and distribute marijuana and a charge of distribution of marijuana.

Allery pleaded guilty to the charges on May 31, 2011.

Allery was given credit for one day in custody and placed on supervised release for two years. He was also ordered to pay a $200 special assessment to the Crime Victim’s Fund and $300 in restitution.

In January 2011 John Allery, Ramona Allery and Derrick Allery possessed marijuana, which was distributed to a confidential informant on the Turtle Mountain Indian Reservation.

On August 25, 2011, John Allery, 23, of Belcourt, ND, was sentenced on a charge of conspiracy to possess with intent to distribute and distribute a controlled substance, a charge of conspiracy to possess with intent to distribute and distribute marijuana, and a charge of distribution of marijuana. He was sentenced to two years and one month in federal prison, to be followed by three years of supervised release. He was also ordered to pay a $300 special assessment to the Crime Victim’s Fund and $6,063 in restitution.

Sentencing for Ramona Allery has been scheduled for October 20 in Bismarck.
