Three from region in NE District Court

Three from the region had probation revoked this week in Northeast District Court, according to a report from Lonnie Olson, Ramsey County States Attorney.

Jonathan Schmidt

Jonathan Schmidt, age 24 of Cando, was revoked on his probation sentence which was imposed after he stole a farmers semi-tractor and trailer on August 28, 2013, and destroyed the trailer in a ditch.

On January 21, 2014, Judge Christofferson placed him on four years of supervised probation for Unauthorized Use of a Motor Vehicle, a C felony, and among many other terms of probation, ordered Schmidt to pay $22,416 in restitution.

After being released to probation, Schmidt committed a Criminal Mischief in the City of Devils Lake in August of 2014, failed to make adequate payments as required by the Court, and absconded from supervision since June 4, 2015.

Judge Christofferson revoked his probation and resentenced Schmidt to five years in the DOCR, with credit for 98 days.

Michael Marion

Michael Marion, age 31 of Dunseith, was revoked on his probation sentence which was imposed after he led Devils Lake Police officers on a chase in 2011 through Devils Lake. 

On November 12, 2011, Marion was driving under the influence and under suspension, and when officers attempted to stop him, he took off at speeds of over 60 mph in the city, nearly hitting other vehicles and going through traffic signs.

After he got out of town, the speed of the pursuit went over 110 mph. He blew a .12 BAC.

On December 30, 2011, the Court sentenced Marion to three years in the DOCR, to serve one year and one day, with the remainder being suspended for three years with supervised probation.

On December 30, 2013, his probation was revoked and the Court ordered Marion to serve an additional 60 days in the local jail. After being released again to probation, he only made one appointment with his probation officer. He has been in jail in Rolette County since July 2015 for an Aggravated Assault.

Judge Christofferson revoked his probation on February 16 and ordered Marion to serve three years in the DOCR, with credit for 463 days served.

Hilari Osley

Hilari Osley, 41 of Devils Lake, was sentenced on the charge of Possession of a Controlled Substance, a C felony.

On December 21, 2015 a deputy was serving an eviction notice for her apartment when he saw evidence of controlled substances. The Deputy obtained a search warrant, and found 88 pills of Methylphenadate (a stimulant), marijuana pipes and a meth pipe.

She was re-arrested on January 27 when she tested positive for meth. Osley entered a guilty plea on February 16, and Judge Christofferson sentenced her to two years in the DOCR, to serve in the LEC until February 27, thereafter she will be released to supervised probation for two years.
