  • Public input requested on proposed ordinance for Devils Lake

  • The Devils Lake City Commission will consider the passage of Ordinance No. 917 at its next meeting, which would permit the sale and use of fireworks in Devils Lake between Dec. 26 and January 1, 2014.

  • If residents of Devils Lake were paying attention this week they would have learned about a proposed ordinance to allow the sale of and use of fireworks over New Year’s in the city of Devils Lake.
    The Devils Lake Journal reported on it as part of the recap of the Devils Lake City Commission story.
    If there is no opposition to this proposed ordinance, after the second reading - set for Oct. 21 at the next city commission meeting - it will become a law in the city.
    The ordinance
    Ordinance No. 917
    AN ORDINANCE, WHICH UPON ADOPTION, SHALL AMEND ORDINANCE NOs. 829, 703, 691, 634 §1, 425 §1, 218 § 1, and 284, WHICH HAVE BEEN CODIFIED AS SECTIONS 8.20.010 and 8.20.020 OF THE DEVILS LAKE MUNICIPAL CODE.
    BE IT ORDAINED, by the City Commission of the City of Devils Lake, North Dakota, pursuant to the Home Rule Charter of the City of Devils Lake, that Ordinance No. 829, 703, 691, 634 §1, 425 §1, 218 § 1, and 284, which have been codified as Sections 8.20.010 and 8.20.020 of the Municipal Code, be amended and shall now provide as follows:
    8.20.010 Sale dates. No person shall sell or offer for sale at retail within the city any fireworks on or before June 27th or after July 5th, or on or before December 26th or after January 1st, of the governing year, all dates inclusive, except as provided in this chapter.
    8.20.020 Use dates. No person shall within the city set off, explode or detonate any fireworks before July 1st or after July 5th or before December 26 or after January 1 in any year, except as provided in this chapter.

    Public input
    Input from the public is vital in all actions taken by the elected bodies like the Devils Lake City Commission. How are commissioners Dale Robbins, Tim Heisler, Craig Stromme, Rick Morse or Mayor Dick Johnson to know what the city’s residents want?
    If this ordinance becomes law, people will be able to purchase fireworks starting on December 26 until January 1.
    The city already has an ordinance that fireworks can only be purchased on June 27 through July 5 for use ONLY July 1 through the 5th to celebrate the nation’s Independence Day.
    This new ordinance would expand the sale and use to around New Year’s Eve, as well.
    And when is New Year’s celebrated? At midnight on December 31.
    If residents of the city want to allow fireworks to be used during this time period, they should say nothing and allow the ordinance to become law.
    However, if residents of the city do not want neighborhood children (and others) shooting off fireworks from December 26 through January 1 each year, those residents need to contact the city and let their wishes be known.
