By Wednesday of this week, the Regime had thrown the Snowden train into reverse. He is no longer the equivalent of bin Laden or Awlaki. Now he’s just a criminal. This is yet another example of a Regime that tends to speak too loudly and without thought in the interest of political pandering, and which is then forced to retrench afterward.

It was really only a matter of time. It wasn’t helping matters that clowns like Michael Hayden were being trotted out to say things like “who did he think he was, telling the American people what the president, the Congress and the FISA Court thought should be kept secret.” Well, a hero, for one, but that was the growing sentiment of Americans too, not just Snowden. And then there were the uncomfortable questions about whether Obama would order a drone strike or SEAL attack on Snowden in the Moscow airport. Or does Obama only put out contracts on Americans when they are Muslims and not Christians? Good question. Better to parry it by downgrading him from a bin Laden or Awlaki to someone more like a litterer. And then there was the growing chorus of international organizations and foreign governments who acknowledged that with the American record at Gitmo and with the ordered attacks on American citizens that Snowden probably would qualify for political asylum under the international law that the American system did not guaranty due process of law. Ooops.

This was all compounded by the evident retreat by the Administration, that not only could it not identify 50 terrorist attacks prevented by spying, but it couldn’t even identify one. So, there isn’t even any indication that the program that was disclosed was providing any security at all.

And then we had the latest Carmen Ortiz over reach. Remember when I asked on this blog why Dzhokar Tsarnev was being tried in federal court rather than state court for murder? (For those already moving on to the next Chandra Levy fixation, Tsarnev set off a bomb at the Boston Marathon in April that killed a couple of people). Well, the answer was that his expressed motivation was his anti-American rhetoric that raised the crime from murder to terrorism. Well, the unsealed indictment has disclosed the basis of this. He had apparently written his anti-American rhetoric on the inside of the boat, and here were the ones that were so egregious that they warrant putting this guy to death for terrorism: “The U.S. Government is killing our innocent civilians” and “I can’t stand to see such evil go unpunished.” He also wrote a tenet of Islam that harming one muslim is akin to harming the body of muslims, which is also a tenet of Judaism. String the guy up! He’s a terrorist! So long as these statements are thought and uttered by a muslim. Oh, wait, there’s more. He was reading Jihadii literature on line and downloading bomb making material from the internet. Never mind that you can get the same material at any American library. And for what it’s worth, a lot of people who think about terrorism had and have been reading the Al Qaeada on-line magazine, but I guess its only a crime to do that if you are a muslim.  But here’s the clincher–he bought fireworks in New Hampshire, which are called “mortars” in the indictment. You know, the reason that our surveillance program didn’t pick up the planned attack is because he wasn’t doing anything illegal that could have been tracked. this was garden variety murder, but Carmen Ortiz seems determined to ride this atrocity for whatever political gain is out there.

Not a good week for the war on terror. But a good week for a study in how this Regime doesn’t have a clue, and that this Regime is a threat to those who speak, think or have the audacity to be outraged.
