Our criminal justice policies are a thicket of human tragedies and unintended consequences. Crime is going down in the U.S., but I’m convinced that’s despite our prison system, not because of it.

In my Sunday column, I consider the case for one small change at the margins, one that will directly effect 500 Massachusetts teenagers every year: Raising the age of adult criminal jurisdiction from 17 to 18.

The case for the change is compelling, based on the science of cognitive development and data showing 17-year-olds held in adult prisons are far more likely to be raped, commit suicide, and return to prison as adult criminals than ones who go through the juvenile system.  Massachusetts, used to be a leader in penal reform and treatment of youthful offenders, but now it is lagging the rest of the country. Blame Willie Horton, one advocate told me.
