A delegation of residents from a neighborhood in the city came before the city commission asking for something to be done about an unkempt piece of property near their homes.
Dale Kruckenberg was the first of three individuals to stand at the podium and explain the situation. The property, now apparently abandoned, has been an ongoing source of concern for the neighborhood because the residents did not mow the grass or clean up garbage.
Devils Lake Fire Chief Jim Moe explained that he and his crew had been there several times but they had no right to enter the property. He thought it did not meet the criteria for a blighted property, at this time, but it would definitely be considered a nuisance. He said they had mowed the lawn a few times already.
After seeing pictures of the property and hearing the testimony the commission decided to act on the nuisance and clean up the exterior of the property and the bill for that work would be added on to the property itself.
Myron Asleson’s crew had been over to clean up garbage in the past and promised to do it again, especially old tires that may be filled with water and breeding grounds for mosquitoes.
There was some uncertainty who owned the property and Chief Moe said he would contact the USDA because they were the most recent entity that rented or had something to do with renting the property.
The commission approved its preliminary budget for the coming year, an estimated $14.9 million budget.
The city voted to accept an offer from the company responsible for an accident that damaged the city’s traffic light rather than to enter into litigation risking further expense for the city and a judgement that may be even less than the $20,465.61 offer.
The commissioners voted to vacate Third Ave. NE between Fifth St. and Sixth Street, where Leevers Foods will be extending their parking lot. Jamie Leevers explained that they wanted to block it off starting Wednesday morning, if possible, because work is begun on the project.
The consent agenda was approved, but one item was removed for later discussion.
Four new ordinances had their first reading at the meeting including the following:
•Ordinance 901 regarding substandard buildings or structures.
•Ordinance 902 certificate of tenancy or occupancy.
•Ordinance 903 regarding building permits.
•Ordinance 904 limiting the number of dogs and cats at a residence in the city. (for those ordinances go to www.ci.devils-lake.nd.us)
Property was purchased to aid the embankment project, three change orders were approved and five payments of construction estimates were authorized.
Page 2 of 2 - Two cost participation and maintenance agreements were approved and property where the city’s new pump station will be located was annexed into the city.
A request to replenish the mini grant funding from Forward Devils Lake was approved.
The city agreed to allow the public dance permit submitted by Ye Olde Tavern to extend its time to 1 a.m. but not to 1:30 a.m. as requested.
